In some countries, immigration processes can only be handled by lawyers or attorneys. Not so in the Czech Republic. The Czech Republic’s approach to immigration is that people should be able to deal with their immigration matters on their own. Although this is still far from a practical implementation, one thing is clear – you do not need an immigration lawyer to handle your case, frankly you do not need a lawyer at all – an experienced Immigration Advisor is in most cases more (not only cost) effective solution.
Let’s discover what are the cases when you should hire a lawyer and when an Immigration Advisor is enough, how to find a professional one and what exactly you will be facing when going through Czech Immigration.
When to use a Czech Immigration Lawyer and when an Immigration Specialist?
The immigration processes in the Czech Republic are still pretty complex but they do not need to be handled by an Immigration Lawyer by the law. Technically anyone can provide advise on immigration matters as long as they have a properly registered business (as a freelancer or a limited liability company).
That comes with some advantages and some disadvantages.
Advantages of using an Immigration Lawyer instead of an Immigration Advisor
The main reason to use an Immigration Lawyer in the Czech Republic is when your application gets denied and or when you are in a serious and/or complex situation.
Courts
For example, only a lawyer can represent you in front of a court in the Czech Republic so if you need to go to a court, you must get a lawyer. Frankly though, since immigration in the Czech Republic generally does not go through courts, if you need a lawyer for this, you are in a place where you should not have ended.
Complex cases where more types of law are involved
Another reason is for sure cases that involve more types of law, rather than just the immigration law. For example if you want to establish a branch of your company in the Czech Republic and start hiring people, you do not only need an immigration lawyer, you’ll need a tax advisor to help you find the best tax strategy, you will need a lawyer covering labor law, corporate law, you will need to get some document templates (i.e. employment contracts, directors contract) prepared. Law firms usually have lawyers of different specializations under their umbrella, as well as tax experts etc.
Advantages of using an Immigration Expert compared to and Immigration Lawyer
Cost transparency
For cases other than above, using an Immigration Specialist might be more reasonable. One of the main advantages is obviously the price. Lawyers generally work based on hourly fee. That means you do not really know exactly how much you will actually pay at the end. Good Immigration Advisors charge per the visa or residence permit you want to get – for example one fixed price for a business visa, one fixed price for a student visa etc. So you know what to expect in terms of the total pay. Not all adviser are transparent about this though and charge you extra for a lot of things.
Flexibility, cost vs value
Let’s be honest, if you hire a lawyer to assist you with your immigration case, the layer will not personally accompany you to your appointment at the Ministry of the Interior. They’ll send their assistant or a paralegal in the best case. That kind nulls the main reason of working with a lawyer.
